What’s the difference between Website Terms and Conditions of Sale and Website Terms of Use?

Website Terms of Use set out the rules for visiting and using your website, and they apply to every website visitor. They include a disclaimer to limit your liability and help to protect your intellectual property.

Website Terms and Conditions of Sale are specifically for customers who place an order through your website to purchase a product. They cover terms for payment, delivery, refunds, warranty etc.

 

Can I have a separate Shipping Policy page on my website?

Yes, you can have a separate Shipping Policy page on your website. However, it should mirror the terms you include in your Website Terms and Conditions of Sale. In other words, you should copy what is in your T&Cs and make sure the same information is reflected in your Shipping Policy.

If you only had a Shipping Policy on your website, a customer could argue that they did not accept the shipping policy, and are therefore not bound by it.

 

Can I have a separate Refund Policy page on my website?

Yes you can have a separate Refund Policy page on your website. However, it should mirror the terms you include in your Website Terms and Conditions of Sale. In other words, you should copy what is in your T&Cs and make sure the same information is reflected in your Refund Policy.

If you only had a Refund Policy on your website, a customer could argue that they did not accept the refund policy, and are therefore not bound by it.

 

Can I still use the Ecommerce Legal Bundle if I also sell to customers overseas?

Yes, our Ecommerce Legal Bundle is suitable if you sell to customers in both Australia and overseas. Our T&Cs include some wording for overseas customers already.

Generally you want the governing law for your legal agreements to be where you are based, so that if a dispute arises you are covered by local laws.

Note, if you sell or market to customers in Europe, you will also need a GDPR Privacy Policy to comply with EU privacy laws. Not only EU businesses have to comply. A GDPR Privacy Policy contains additional terms and clauses which must be included to make it compliant with the GDPR.

 

Can’t I just copy these documents from another website?

We don’t recommend this approach for a few reasons:

1. You may be committing copyright infringement, which is against the law.

2. You might accidentally copy terms and conditions from another country – if you end up in court for some reason it might be on the other side of the world!

3. Our templates have been drafted by an Australian lawyer to make sure they’re legally binding here in Australia.

 

Are these templates editable?

Yes, the templates come in Word format so you are free to make changes to the documents.

However, we do not recommend you make changes outside of the fields we have highlighted in the documents. The clauses and wording have been written by a lawyer for a good reason. Deleting clauses or modifying them can affect the legal protections contained in the documents.

 

What if the law changes?

If the law changes, we’ll email you with the changes and updates to add to your existing templates. So please ensure you keep us updated if your email address changes.

Easy set up

We are happy with the documents provided by "easy legal". The instructions were very clear. As a small company we feel comfortable that the legal aspects of our website are covered. Also, a good point to mention, other sites do not provide a sample before you purchase, whereas "easy legal" does.
