Who can use this Ecommerce Legal Bundle?

What's Included in the Ecommerce Legal Bundle?

website terms and conditions

1. Website Terms & Conditions of Sale

Website Terms and Conditions of Sale are the terms and conditions you set for customers who purchase products on your website. They form a legal agreement that customers accept when they place an order through your website.

All of your important ecommerce terms and conditions are included in this document, such as payment, delivery, refunds and warranty. Under Australian Consumer Law, you MUST display terms and conditions on your website if you are selling online.

2. Privacy Policy

A Privacy Policy is a document that explains how you will manage the personal information you collect from website visitors and customers. Most Australian websites need a privacy policy to comply with Australian privacy laws.

Even if you have a simple website, you should have a Privacy Policy. There are sizable fines for breaching the Privacy Act, so it is important to comply.

3. Website Terms of Use

Website Terms of Use set out the rules for your website visitors. They are designed to protect you from the risks associated with running a website, and to protect your intellectual property as well.

Our Website Terms of Use template includes rules about what visitors can and can’t do on your website (such as post comments or share your content). It also includes a Website Disclaimer to limit your liability for any loss incurred by someone relying on the information on your website.

4. Guide to the Australian Consumer Law

Whether you sell goods or provide services, whether you work with customers or other businesses, it’s important to understand your obligations and how the Australian Consumer Law (ACL) affects your business and its practices. Our Guide to the Australian Consumer Law will help you avoid the hefty fines attached to non-compliance with the ACL.

This guide is an internal document for your reference and does not need to be published on your website.

5. Guide to Product Liability

As a business owner, if you’re held liable for personal injuries suffered by a consumer as a result of your product, the damages could not only sink your business but leave you (personally) bankrupt as well. Our Guide to Product Liability will help you understand your product safety obligations, so you can protect yourself and your business.

This guide is an internal document for your reference and does not need to be published on your website.

Are these templates legally binding?

All of our templates have been drafted by qualified Australian lawyers who hold an Australian legal practicing certificate.

We are affiliated with a commercial law firm based in Sydney.

More Details

What if I sell to Australia AND overseas customers?

No worries, you can still cover this in one document. Just make sure you update any relevant sections on payment, shipping, returns etc., to include international customers.

Generally, you want the governing law for your legal agreements to be where you are based so that if a dispute arises, you are covered by local laws.

If you sell or market to customers in Europe, you will also need a GDPR Privacy Policy to comply with EU privacy laws.

Do I need a separate Refund Policy page on my website?

No, refunds are already covered in your Terms and Conditions.

However, you might want to add a Refund Policy page to your website to make it easier for customers to find the information.

IMPORTANT: If you decide to add a Refund Policy page, it should mirror the terms you include in your Website Terms and Conditions of Sale.

In other words, the info displayed on your Refund Policy page should be the same as what you have written in your T&Cs.

If you only had a Refund Policy page on your website, a customer could argue that they did not accept the refund policy and are therefore not bound by it.

Very happy with purchase

Terms contain all relevant information, Easy to use template, although would be handy if certain fields such as Entity and ABN etc. were able to link between the three documents it would have saved entering in some information 3 times.

Online Course Terms & Conditions

I work as a solicitor but creating T&C's for an online course is not my area of speciality. So, when starting up my side business, I was recommended Easy Legal Templates and decided to purchase the terms to help streamline the setup process! The document is extremely easy to use (and it legally makes sense!) and I think it's fantastic that the legal process has been simplified so well for small business owners.
